3M™ Combat Arms Earplug™ Lawsuit
The law firm of Mansfield, Melancon, Cranmer & Dick, LLC is investigating potential claims against the manufacturer of the Dual-Ended Combat Arms Earplugs™ (CAEv2). The Combat Arms Earplugs™, manufactured by The 3M™ Company, were standard-issue equipment for thousands of military service members between 2003 and 2015. Defects in the earplugs design and manufacturing put the members of the United States Armed Forces at risk for permanent hearing loss, impairment, and tinnitus.
history behind the 3m lawsuits
3M™ is a Minnesota based company that produces, among other products, Combat Arms Earplugs™ that were regularly used by United States military personnel from 2003 through 2015. The Department of Justice announced in July 2018 that 3M™ agreed to pay $9.1 million to resolve allegations that it knowingly sold the dual-ended Combat Arms Earplugs™, Version 2 (CAEv2) to the United Sates military without disclosing defects that hampered the effectiveness of the hearing protection device (click here to read the press release). More specifically, the United States claimed that 3M™, and its predecessor, Aearo Technologies, inc., knew the CAEv2 was too short for proper insertion into users’ ears and that the earplugs could loosen imperceptibly and therefore did not perform well for certain individuals. Further, 3M™ did not disclose this design defect to the military. However, this settlement did not resolve any individual claims that active or veteran military personnel might have against 3M™.
